Default Oklahoma Declares Sovereignty

STATE OF OKLAHOMA
2nd Session of the 51st Legislature (2008)
HOUSE JOINT
RESOLUTION 1089 By: Key
AS INTRODUCED
A Joint Resolution claiming sovereignty under the
Tenth Amendment to the Constitution of the United
States over certain powers; serving notice to the
federal government to cease and desist certain
mandates; and directing distribution.
WHEREAS, the Tenth Amendment to the Constitution of the United
States reads as follows:
"The powers not delegated to the United States by the
Constitution, nor prohibited by it to the States, are reserved to
the States respectively, or to the people."; and
WHEREAS, the Tenth Amendment defines the total scope of federal
power as being that specifically granted by the Constitution of the
United States and no more; and
WHEREAS, the scope of power defined by the Tenth Amendment means
that the federal government was created by the states specifically
to be an agent of the states; and

WHEREAS, today, in 2008, the states are demonstrably treated as
agents of the federal government; and
WHEREAS, many federal mandates are directly in violation of the
Tenth Amendment to the Constitution of the United States; and
WHEREAS, the United States Supreme Court has ruled in New York
v. United States, 112 S. Ct. 2408 (1992), that Congress may not
simply commandeer the legislative and regulatory processes of the
states; and
WHEREAS, a number of proposals from previous administrations and
some now pending from the present administration and from Congress
may further violate the Constitution of the United States.
NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES
AND THE SENATE OF THE 2ND SESSION OF THE 51ST OKLAHOMA LEGISLATURE:
THAT the State of Oklahoma hereby claims sovereignty under the
Tenth Amendment to the Constitution of the United States over all
powers not otherwise enumerated and granted to the federal
government by the Constitution of the United States.
THAT this serve as Notice and Demand to the federal government,
as our agent, to cease and desist, effective immediately, mandates
that are beyond the scope of these constitutionally delegated
powers.
THAT a copy of this resolution be distributed to the President
of the United States, the President of the United States Senate, the
Speaker of the United States House of Representatives, the Speaker

of the House and the President of the Senate of each state's
legislature of the United States of America, and each member of the
Oklahoma Congressional Delegation.

This movement towards states rights gives me a little bit of hope. I hope the Ron Paul supporters out there will get behind this on a local level.

Not so sure, the OK governer as told the feds that the Nafta superhighway will not cross their border.

I am with you in that this is a preemptive strike against the super highway, among other things of course.

But to be serious, they also have to quit living off federal largess.

You can't refuse one, and accept another, or your case is immaterial to a court, which of course this will all end up in.

no fed highway money,
no fed education money,
no fed special projects,
no fed prisons,
and so on.

This is a good thing if all states would join in, which of course they won't. To make it effective, they would also have to cut the purse going to Washington ie keep their monies at home other than what is 'allowable' fed govt.

Yup. I'll believe they are serious when they not only reject all federal money, but also direct all county recorders not file federal tax liens and levies, all state chartered banks not to turn money over to the feds, the state military reserve forces to stay in the state without a declaration of war having been passed by congress, and direct all state and local law enforcement not to not only not cooperate with federal agents, but to arrest them if they attempt to operate with-in the state. Anything short of that is just politics as usual.

The tax issue is critical. If a state is continuing to pay tribute to its master, the latter really will not care about its slave whining slightly. If a client state allows its overlord open access to the property and people of the former, any complaining is even more silly.

But, in fairness to Oklahoma, let us give them the chance to back up this resolution with something substantive. I do know that a lot of people from the Midwest are furious about the trans-NAFTA corridor, so this might be more than bluster.

The people in my state were furious when the toll road was leased to Cintra, I've made it a point to tell anyone who will listen, that Cintra is the SAME company building the Trans-Texas Corridor. The 80-90 Toll Road is planned to be apart of the Nafta super higway.

the issue with highways is that they are already in place, and they are maintained by the state anyway, so if the fed. gov. cut off funding, it may not be a big deal.

You underestimate the cost of road maintenance/upkeep and expansion. Costs are literally in the millions of dollars per mile. I've heard over the course of a decade a given stretch of asphalt will cost in maintenance over 3 times the costs involved in initial installation. Roadwork funding is a major piece of leverage for federal authority over state authority.

The cost of engineering, land acquisition, grading and bridge construction is huge. I suppose anything's possible, but its hard to believe that maintence for 10 years exceeds installation, upkeep, and expansion costs.

Also, don't the taxes collected at the pump by far exceed the monies spent on highways?

Just because the Federal Government pays millions of dollars for upkeep doesn't mean that it costs millions of dollars. A major portion of the Federal Government roadway bribery scheme goes to pay for state troopers and DOT/DPS revenue agents disguised as state troopers.

Actually the cost for maintenance is much less. In Mass where its one of the highest in the nation it is 80k a mile and in NH one of the lowest at 8k per mile. The difference in price? Corruption.

Other than excise taxes (Taxes that you can avoid) Taxes should be apportioned among the states. Thats what the constitution says, Dit the founding fathers put that in there just to add some meaningless words?
Direct taxes need to be apportioned, Direct taxes are taxes that you can not avoid. So, can Congress tax us as individuals? Yes but they need to apportion the states and then the staes need to collect from its citizens. If the citizeny revolts then this puts the power back in the citizenry where it belongs. If we would only go back to the constitution, washington would be shut down in a heartbeat.

I may be off base here, but I am under the impression that highway expansion is exactly what OK wants to aviod.

I hate to rain on this chain of thought but; Oklahoma declared Sovereignty under the 10th Amendment, they did not secede from the union. Everyone in Oklahoma is still subject to income confiscation taxes via the 16th Amendment. They are also still obligated to use the congressionally declared coin of the realm, which is FRNs.
